As Polygon Machine Endüstri Makinaları İmalat San. ve Tic. Ltd. Şti. (“Polygon Machine”), protecting the security and confidentiality of your personal data in accordance with the Law on the Protection of Personal Data No. 6698 (“Law”) is among our company’s top priorities.
Therefore, we conduct our business in compliance with the laws applicable to data privacy and data security.
Within this scope, we would like to inform you about the processes and principles regarding the collection, processing, transfer, and storage of personal data by Polygon Machine, as well as your rights arising from the Law.
1. Purpose of Processing Your Personal Data
Your personal data collected on a legal basis will be processed in accordance with the principle of good faith, in connection with the purposes of processing, in a limited, proportionate, accurate, and up-to-date manner, and for specific, explicit, and legitimate purposes.
Your personal data will be processed for the purposes of:
Getting to know you better and understanding your needs,
Responding to your requests more quickly and providing services,
Improving our communication with you,
Offering more personalized products, services, and offers,
Informing you about our products and services,
Measuring and improving your satisfaction,
Diversifying our products and services in line with your requests and needs,
Performing quality and standard audits as required by relevant laws and regulations,
Fulfilling legally mandatory reporting and obligations.
2. Method and Legal Basis of Collecting Your Personal Data
Your personal data may be collected by Polygon Machine or real or legal persons processing data on behalf of Polygon Machine through:

Social media accounts,
Mobile applications,
Contracts,
E-mails,
Application forms and similar means,
by automatic or non-automatic methods, verbally, in writing, or electronically.
3. Use of Social Plugins
Social media plugins such as Facebook, YouTube, Instagram, LinkedIn are used on the Polygon Machine website.
These plugins will not be active unless clicked. However, when you activate these plugins, a connection is established with the relevant social media sites and you give your consent for data transfer.
If you are logged into your social media account, your visit to our website may be associated with your account.
You can review the data protection policies of the relevant social media sites to get information on how your data is collected and processed.
If you do not want data to be collected via these links, you must log out of your social media accounts before visiting our website.
4. Use of Cookies
Cookies used on our website do not store or disclose personal information.

Within the scope of Law No. 6698, you have the following rights:
To learn whether your personal data is being processed,
To request information if it has been processed,
To learn the purpose of processing and whether it is used in accordance with its purpose,
To know the third parties to whom it is transferred domestically or abroad,
To request correction if it is incomplete or incorrectly processed,
To request its deletion or destruction,
To request notification of the correction, deletion, or destruction to third parties to whom it has been transferred,
To object to analyses carried out exclusively through automated systems,
To request compensation for damages if you suffer damage due to unlawful processing.

Your applications will be concluded within 30 days at the latest, in accordance with Article 13 of the Law.
Polygon Machine: The legal entity Polygon Machine Endüstri Mak. İmalat San. Tic. Ltd. Şti. selling the product(s).
CUSTOMER: Refers to the legal entity purchasing the product(s).
PRODUCTS: Refers to machinery, equipment, and/or spare parts.
Polygon Machine agrees to sell the products at the agreed price under the Standard Terms specified below, subject to the Customer’s acceptance.
These terms apply to all sales, including electronically placed orders.
1. SCOPE
The scope of the products sold by Polygon Machine is exclusively described in the product specifications attached to the sale or purchase of the products by Polygon Machine.
Unless otherwise agreed in writing, this scope does not include any services or commitments of Polygon Machine, including but not limited to installation or initial commissioning of the products.
2. PRICE AND PAYMENT
Taxes and duties are not included in the prices.
All payments shall be made in the currency specified in the offer (TRY, USD, or EUR).
Payments must be made in accordance with the terms specified in the offer.
If payment is not made, shipment will not be allowed or only partial shipment may be made.
Each shipment is considered a delivery, and payment becomes due in proportion to the shipment.
If the buyer delays the shipment, the date the shipment is ready will be considered the delivery date for payment purposes.
Polygon Machine reserves the right to store the products at the buyer’s risk and expense.
If the buyer does not pay by the due date, Polygon Machine applies 2% monthly interest on the total price of the products.
3. DELIVERY
Products are delivered ex-works.
Under no circumstances shall Polygon Machine be held responsible for delays beyond its own commitments.
4. RESPONSIBILITIES AGAINST MANUFACTURING AND WORKMANSHIP DEFECTS
4.1
Polygon Machine shall repair or replace defects arising from defective materials or workmanship in the products.
4.2
Except for spare parts and consumables, Polygon Machine’s warranty on the products is limited to manufacturing, assembly, and workmanship defects detected within 24 months from delivery.
4.3
The Customer shall immediately notify Polygon Machine in writing of any defect.
Warranty is void for defects not notified in writing, and the Customer shall be liable for damages arising therefrom.
4.4
After receiving written notice, Polygon Machine agrees to provide service within 24 hours, subject to existing conditions.
Polygon Machine shall not be held responsible for service delays arising from part supply or manufacturing processes.
Defective parts will be repaired or replaced.
Parts under warranty are free of charge.
Service and transportation costs shall be borne by the Customer.
4.5
During the warranty period, all travel, accommodation, and meal expenses for services provided by Polygon Machine shall be borne by the Customer.
4.6
All wear parts (liners, bolts, throats, gears, bearings, seals, etc.) are excluded from the warranty.
4.7
For ready-made materials not produced by Polygon Machine (motors, gearboxes, bearings, lubrication systems, electrical panel materials, etc.), the manufacturer’s warranty conditions apply.
However, the responsibility and organization of the equipment belong to Polygon Machine.
4.8
Replaced parts are the property of Polygon Machine.
4.9
Polygon Machine is only responsible for defects occurring under the operating conditions specified by itself or mutually agreed upon in writing between the parties.
Modifications made by the Customer or third parties are excluded from the warranty.
4.10
If a defect is determined that Polygon Machine is not responsible for, Polygon Machine has the right to claim its expenses.
4.11
For the warranty process to be valid, it is mandatory to use spare parts specified by Polygon Machine.
4.12
A maintenance contract must be made with Polygon Machine for the warranty period.
If no maintenance contract is made, the customer must fully fulfill all maintenance conditions.
If a maintenance contract is made, Polygon Machine will provide service 4 times a year (once every 3 months).
4.13
Polygon Machine cannot be held responsible for capacity guarantees, production loss, profit loss, or operational damages not explicitly stated in the initial sales contract.
5. FORCE MAJEURE
5.1
Industrial disputes, natural disasters, fire, war, mobilization, seizure, civil war, transportation or material shortages, energy restrictions, etc. are considered force majeure.
These situations are beyond the control of the parties and may cause delays in the performance of the contract.
5.2
The party experiencing force majeure is obliged to notify the other party in writing.
5.3
If the force majeure continues for more than six months, both parties have the right to terminate the contract.
6. INTELLECTUAL PROPERTY AND RESPONSIBILITIES
6.1
If the design or manufacture of Polygon Machine products causes any patent or copyright infringement in the customer’s country, the customer shall notify Polygon Machine, and Polygon Machine shall assume the necessary defense.
6.2
Drawings, specifications, data, software, instructions, and other documents provided by Polygon Machine may only be used for the installation, operation, maintenance, and repair of the products.
These documents may not be copied, reproduced, or shared with third parties.
7. INDIRECT AND CONSEQUENTIAL LOSSES
Neither party shall be held liable to the other for production loss, profit loss, loss of use, or other indirect losses.
8. CUSTOMER’S PERMITS, APPROVALS, DATA
The Customer shall obtain all permits and licenses required for the installation and operation of the products and pay the relevant fees.
Polygon Machine’s ability to deliver on time depends on the Customer providing the necessary technical and commercial documents.
9. RETENTION OF TITLE
The ownership of the products belongs to Polygon Machine until full payment is made.
The Customer is obliged to assist Polygon Machine in protecting this ownership right.
10. REJECTION OF PRODUCTS
All claims leading to the rejection of products must be reported in writing to Polygon Machine within 7 business days from delivery.
If no notice is given within this period, the products shall be deemed definitively accepted.
11. FOUNDATION, CONSTRUCTION, INSTALLATION RESPONSIBILITIES
The construction and adequacy of the foundation are the responsibility of the Customer.
Polygon Machine may only send an assembly and commissioning supervisor for a limited time.
TRAVEL, ACCOMMODATION, and MEAL expenses shall be borne by the Customer.
Unless otherwise agreed in writing, Polygon Machine shall not be held responsible for construction works, energy-water-air expenses, dismantling-assembly operations, etc.
12. DISPUTES AND LEGAL RESPONSIBILITIES
All disputes shall be resolved in the courts of the province where Polygon Machine is domiciled.
The sale and purchase of products are subject to the laws of the Republic of Türkiye.
13. POLYGON MACHINE PRODUCTS UNDER WARRANTY
13.1
This warranty applies only to Polygon Machine equipment, machinery, elements, parts, and services.
13.2
This warranty supersedes all other warranties, obligations, and remedies related to the equipment and services provided by Polygon Machine.
